New York paid sick leave
Up to 56 hours of paid sick leave per year (employers with 100+ employees)
New York's paid sick leave law (Labor Law section 196-b) requires employers with 100 or more employees to provide up to 56 hours of paid sick leave a year; employers with 5-99 employees provide up to 40 paid hours, and employers with 4 or fewer provide 40 hours, paid only if net income is over $1 million. Leave accrues at 1 hour per 30 hours worked, and since January 1, 2025 workers also get 20 hours of paid prenatal leave.

Local notes & what to do
Several New York wage rules split by region: from January 1, 2026 the exempt salary threshold is $1,275.00 per week in New York City and Nassau, Suffolk and Westchester counties, versus $1,199.10 per week in the rest of the state, and tipped cash wages are also higher downstate. Paid family leave pays 67% of average weekly wages for up to 12 weeks, capped at $1,228.53 per week in 2026. New York also gives most workers 20 hours of paid prenatal leave on top of sick leave, a rule in place since January 1, 2025.
